Provision of Information Document

1. If the Company requests Personal Data from the Customer, the Customer may decline to provide that Personal Data, but in that event the Company may decline to provide the Service to the Customer.



2. Notwithstanding any confidentiality provisions included in the Customer Agreement, the Customer agrees that the Company may use the Personal Data for any and all of the following purposes:



1. provision of the Service to the Customer (including transfer of such Personal Data to other telecommunication network providers or third parties as necessary for the provision of the Service);



2. matching (as defined in the Personal Data (Privacy) Ordinance) the Personal Data with other data collected for other purposes and from other sources including third parties in relation to the provision of the Service.



3. marketing of goods and/or services by the Company, its agents, Affiliates or subsidiaries, in relation to the Service;



4. improving of goods and/or services in relation to provisioning of the Service;



5. processing of any benefits arising out of or in connection with the Service;



6. nalysing, verifying and/or checking of the Customer's credit, payment and/or status in relation to provision of the Service;



7. processing of any payment instructions, direct debit facilities and/or credit facilities in relation to provisioning of the Service or as requested by the Customer;



8. enabling the daily operation of the Customer's account and/or the collection of amounts outstanding in the Customer's account in relation to the Service;



9. enabling the Company to comply with its obligations to third parties in relation to the Service and the Software Products, to interconnect or other industry practices;



10. keeping the Customer informed of other services of the Company;



11. prevention or detection of crime;



12. disclosure as required by law; and



13. any other purposes as may be agreed between the parties.


3. Notwithstanding any confidentiality provisions included in the Customer Agreement, the Customer agrees that the Personal Data may be disclosed and transferred in Hong Kong or in places outside Hong Kong to the Company's Affiliates, agents, contractors, telecommunications operators, any other third parties, including, collection agencies, credit reference agencies, security agencies, credit providers or other financial institutions and any of Company's actual or proposed assignees or transferees of its rights and obligations in respect of the Customer for such person to use, disclose, hold, process, retain or transfer for the purposes listed in paragraph 2 above.



4. The Customer shall, as soon as practicable, notify the Customer of any change of address or any other particulars provided to Company which may affect the provision of the Service to the Customer.



5. On request by the Company, the Customer shall provide the Company with information relating to the Customer and its use of the Service reasonably required by the Company:



1. to assist the Company in complying with its obligations under any Applicable Law and to report to any Government Agency regarding compliance with those obligations; and



2. to assess whether or not the Customer has complied, is complying and will be able to continue to comply with all its obligations under the Customer Agreement.

Capitalised terms in this document shall have the following meanings:

"Affiliate" means, in relation to an entity, any other entity that directly or indirectly controls, is controlled by, or is under common control with, such entity;

"Company" means PCCW IMS Limited, PCCW Powerbase Data Center Services (HK) Limited, PowerbaseEngines Company Limited or an Affiliate of such company (as applicable).

"Government Agency" means any government or governmental, semi-governmental, administrative, fiscal or judicial body, department, commission, authority, tribunal, agency or entity in any part of the world and includes the person appointed as the Telecommunications Authority under the Telecommunication Ordinance.

"Personal Data" means Customer information including the Customer's name, address, Customer identifier number, Software Products that the Customer intends to make use of in connection with the Service and personal data as defined in the Personal Data (Privacy) Ordinance obtained from the Customer, or from another source.

"Service" means the service provided to the Company to the Customer and identified in the Customer Agreement.

"Software Products" shall (where applicable) have the meaning specified in the Customer Agreement.
